DAYTON TOWNSHIP CEMETERIES POLICY.

This policy shall cover all Dayton Township owned and operated cemeteries located within Dayton Township, Tuscola County, Michigan including but not limited to St. Agatha Cemetery, Dayton Center Cemetery, and West Dayton Cemetery.

 

DEFINITIONS OF CEMETERY LOTS AND BURIAL SPACES

  • A cemetery lot shall consist of burial spaces sufficient to accommodate from one (1) to eight (8) burial spaces.

  • An adult burial space shall consist of a minimum land area of (42) forty-two inches in width and (8) eight feel in length.

 

SALE OF LOTS OR BURIAL SPACES

  • All sales of cemetery lots or burial spaces shall be made on a form approved by the Dayton Township Board, which grants a right to burial only and does not convey any other title to the lot or burial space sold. Such form shall be executed by the Dayton Township Treasurer or designee.

  • Burial rights may only be transferred to those persons eligible to be original purchasers of cemetery lots or burial spaces within Dayton Township and may be effected only by endorsement of an assignment of such burial permit upon the original burial permit form issued by Dayton Township Treasurer, approved by said Treasurer, and entered upon the official records of said Treasurer. Upon such assignment, approval and record, said Treasurer shall issue a new burial permit to the assignee and shall cancel and terminate upon such records, the original permit thus assigned.

  • Lot owners shall not allow interments in their lots in return for remuneration of any kind.

 

PURCHASE PRICE

The Dayton Township Board by resolution may periodically set and adjust the fee for burial spaces to accommodate increased costs and needed reserves for cemetery maintenance and acquisition.

 

REPURCHASE OF LOTS OR BURIAL SPACES

Dayton Township will repurchase any cemetery lot or burial space from the owner for the original price paid the Township upon written request of said owner or his/her legal heirs or representatives.

 

GRAVE OPENING CHARGES

  • The opening and closing of any burial space, prior to and following a burial therein, and including the interment of ashes, shall be at a cost to be determined from time to time by resolution of the Dayton Township Board, payable to Dayton Township.

  • No burial spaces shall be opened and closed except under the direction and control of the cemetery sexton.  This provision shall not apply to proceedings for the removal and reinterment of bodies and remains, which matters are under the supervision of the local health department.

 

VAULT

All burials shall be within a standard concrete vault installed or constructed in each burial space before interment (per Dayton Township Resolution

dated May 6, 1996).

 

MARKERS OR MEMORIALS

  • All markers or memorials must be of stone or other equally durable composition.

  • Any monument must be located upon a suitable solid foundation, which extends at least (4) four inches beyond the marker and is flush with the ground.

  • Only (1) one monument, marker or memorial shall be permitted per burial space.

  • No more than (4) four markers per burial space for (4) four individual cremains or (1) marker for all cremains. Individual markers for cremains shall be flush with ground and shall be no more than (12) twelve inches by (24) twenty-four inches.

  • Should any monument or memorial become unsightly, dilapidated or a safety hazard, the Dayton Township Board shall have the right, at the expense of owner, to correct the condition or remove same.

INTERMENT REGULATIONS

  • Only (1) one person may be buried in a burial space except for; a mother and infant or (2) two children buried at the same time or (1) one person and (1) one cremain.

  • Only (4) four cremains are allowable per burial space.

  • Not less than a 36-hour notice shall be given in advance of any time of any funeral to allow for the opening of the burial space.

  • The appropriate permit for the burial space involved, together with the appropriate identification of the person to be buried therein, where necessary, shall be presented to either the cemetery sexton or the Dayton Township Treasurer or designee prior to interment. Where such permit has been lost or destroyed, the Dayton Township Treasurer or designee shall be satisfied, from his or her records, that the person to be buried in the burial space is an authorized and appropriate one before any interment is commenced or completed.

  • No lot shall be used for any purpose than the burial of the human deceased.

 

RECORDS

The Dayton Township Clerk or designee shall maintain records concerning all burials, issuance of burial permits, and any perpetual care fund, separate and apart from any other records of Dayton Township and the same shall be open to public inspection at all reasonable business hours.

 

EFFECTIVE DATE OF POLICY

Effective date of this policy shall be upon adoption by the Dayton Township Board.

DAYTON TOWNSHIP CEMETERY GROUNDS MAINTENANCE POLICY - EFFECTIVE APRIL 2001

  • NO BUSHES, PLANTS, SHRUBS, OR TREES SHALL BE PLANTED without the approval of the cemetery Sexton or the Township Treasurer. The Township or the Sexton may remove any of the foregoing items planted without such approval.

  • THE TOWNSHIP RESERVES THE RIGHT RIGHT to remove or trim any bush, plant, shrub, or tree located within the cemetery in the interest of maintaining proper appearance and the use of the cemetery.

  • THE SEXTON SHALL HAVE THE RIGHT  to remove and dispose of any and all GROWTH, EMBLEMS, DISPLAYS, OR CONTAINERS therefore, that through deterioration and damage, or are otherwise unsightly, become a source of litter or a maintenance problem.

  • RUBBISH, WASTE & REFUSE OF ANY KIND MUST BE REMOVED FROM PREMISES, including but not limited to artificial floral displays, wreaths, grave blankets, wire & plastic display brackets, flower containers and papers.

  • GLASS RECEPTACLES ARE NOT ALLOWED

  • ARTIFICIAL FLORAL DISPLAYS ARE NOT PERMITTED April 1 through November 1, unless placed securely in a vase permanently fastened to the monument, or in an urn capable of withstanding the elements.

  • WINTER DECORATIONS MAY BE MAINTAINED November 1 through April 1.

 

CEMETERY HOURS: HOURS OF CEMETERY OPERATION SHALL BE FROM DAWN TO DUSK
